2. No Medical, Mental Health, or Crisis Advice

2.1 Informational Purposes Only

All content on this Site (including articles, copy, FAQs, videos, downloadable materials, and any other information) is provided for general informational and educational purposes only. It is not medical advice, mental health advice, counseling, diagnosis, or treatment, and should not be relied on as a substitute for an in-person evaluation by a qualified health professional.

2.2 No Provider–Client Relationship from Site Use

Your use of this Site, including sending us messages through forms, email, or chat, does not create a counseling, coaching, therapist–client, doctor–patient, or any other professional relationship with Dr. Phelps or Dr. Phelps LLC.

A professional relationship is only formed after:

You have completed any required intake or consent forms,
We have formally accepted you as a client, and
An appointment or service has been scheduled and confirmed.

2.3 Not for Emergencies or Crises

The Site, including any forms, chat features, or email addresses, is not monitored 24/7 and is not appropriate for emergencies or crisis situations.

If you are experiencing a medical or mental health emergency or are in immediate danger, do not use this Site. Call 911, go to your nearest emergency room, or contact a local emergency service or crisis hotline (for example, in the United States you can call or text 988 for the Suicide & Crisis Lifeline).

3. Eligibility and Intended Use

This Site is intended for:

Adults seeking information about services for themselves or loved ones;
Organizations, schools, churches, and other groups seeking consulting, curriculum, or workshop support.

You may use the Site only if you:

Are at least 18 years old, or using the Site with the consent and supervision of a parent or legal guardian; and
Have the legal capacity to enter into a binding agreement under applicable law.

If you do not meet these requirements, you must not use the Site.

Clinical counseling or similar professional services are only provided to individuals and organizations in jurisdictions where Dr. Phelps or other providers are duly licensed and in accordance with applicable laws and professional standards.

15. Termination

We may, in our sole discretion, suspend or terminate your access to all or part of the Site at any time and for any reason, including but not limited to:

Any violation of these Terms;
Suspected fraudulent or abusive activity; or

Upon termination, the rights and licenses granted to you under these Terms will immediately cease, but any provisions that by their nature should survive (such as limitation of liability, indemnification, and intellectual property provisions) will remain in effect.

16. Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Dr. Phelps LLC regarding your use of the Site and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral, relating to the subject matter herein.
